Terms & Conditions
The rules for using 529able.com and our services, in plain language.
1. Who we are
529able (“we”, “us”) provides physician documentation services for ABLE account eligibility through 529able.com and a secure client portal operated by a third-party, HIPAA-compliant platform.
2. Our services
We coordinate a review of your medical records by a licensed physician against ABLE eligibility criteria under Section 529A of the Internal Revenue Code.
Where the evidence supports it, the physician signs an ABLE disability certification. Certification is issued at the physician’s professional discretion and is not guaranteed.
3. Eligibility to use the service
You must be at least 18, or acting as a parent, legal guardian or authorized representative of the account beneficiary.
Services are available only in states where our physicians are licensed.
4. Not medical, legal, tax or financial advice
Information on this website is general and educational. It is not medical, legal, tax or financial advice. Please consult a qualified professional about your situation.
5. Your responsibilities
You agree to provide accurate, complete information and genuine medical records, and to keep your portal login secure.
6. Fees, payment and refunds
Our fee is a flat $189, shown before you pay.
If you cancel before the physician starts reviewing your records, we will refund your fee in full. Once the review has started, the fee covers the physician’s time and is not refundable, even if the evidence does not support certification. If your records are incomplete, we will tell you what is missing so you can add it at no extra cost.
7. Telehealth
Some evaluations may include a telehealth call or secure messaging. Telehealth has limitations compared with in-person care; no physical examination is performed.
8. Third-party platforms
Your account, forms, records, messages and payments are handled through our client portal provider and payment processor, subject to their terms.
9. Limitation of liability
To the fullest extent allowed by law, 529able is not liable for indirect, incidental or consequential damages, including decisions made by an ABLE program, benefits agency or financial institution. Our total liability for any claim related to our services is limited to the amount you paid us for that service. Nothing in these terms limits liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. The “Last updated” date shows the latest version.
11. Governing law
These terms are governed by the laws of the United States and of the state in which 529able is organized, without regard to conflict-of-law rules. Any dispute will be handled in the courts of that state, unless the law of your state requires otherwise.
